iFinex Inc. and/or its affiliates own the trademarks and copyrights represented in the ‘Bitfinex’ brands (the “Brands”), including, without limitation, ‘Bitfinex’, ‘Bitfinex Pay’ ‘Bitfinex Honey’, the ‘Honey Framework’, ‘Bitfinex Securities’ and the leaf, honey logos. All use of these Brands by third parties must follow the following guidelines, without exception (the “Public Guidelines”) except: (i) with iFinex’s and/or its affiliates’ express written permission; or (ii) for Bitfinex Pay Merchants, in accordance with the Bitfinex Pay Guidelines below.

If you have been granted BITFINEX PAY Merchant status (“Merchant(s)” or “Merchant Status”), the following BITFINEX PAY Brand Guidelines (“Bitfinex Pay Guidelines” and together with the Public Guidelines, the “Guidelines”) apply to your use during the term of your Merchant Status. If you have not already achieved Merchant Status with Bitfinex, please refer to our Public Brand Guidelines instead. The licensed uses granted in these Bitfinex Pay Guidelines are reserved exclusively for Merchants. Upon termination of your Merchant Status, your ability to operate under these Guidelines will cease, and your use will need to conform with iFinex Inc. and/or its affiliates’ Public Brand Guidelines going forward. Failure to conform use to the Public Brand Guidelines after the termination of your Merchant Status could result in liability to you for violating iFinex Inc. and/or its affiliates’ intellectual property rights.

Any use of our Brand(s) inures solely to iFinex Inc.’s and/or its affiliate’s benefit and all use must comply with these Guidelines or an applicable license. Third parties, including licensees, may never claim ownership rights in our Brand(s), or brands that are confusingly similar to our Brand(s), in any manner, including without limitation as a trademark, service mark, company name or designation, domain name, social media profile/handle, or in any other manner. iFinex Inc. and/or its affiliates expressly reserve the right in its sole discretion to terminate, revoke, modify, or otherwise change permission to use its Brand(s) at any time and expressly reserves the right to object to any use or misuse of its Brand(s) in any jurisdiction worldwide.
